These Terms of Service ("Terms") govern your use of Readflexes (the "Service"). By using the Service, you agree to these Terms.
Who can use Readflexes
The Service is intended for teachers, schools, and authorized users. You are responsible for ensuring your use complies with applicable laws and school policies.
Your account
- You are responsible for safeguarding your login credentials.
- You agree to provide accurate information.
- You are responsible for activity that occurs under your account.
School and district use; Data Privacy Agreements
When the Service is used with students under the direction of a school or district, the school owns and controls student data and Readflexes acts as a school official / service provider on the school's behalf, as described in our Privacy Policy. Where a signed DPA exists between Readflexes and a school or district, the DPA's terms regarding student data take precedence over these Terms.
Student data
If you import data from Google Classroom or another source, you represent that you have authorization to share that data with Readflexes for educational purposes. We handle student data consistent with our Privacy Policy and any applicable DPA.
Acceptable use
- Do not misuse the Service or attempt unauthorized access.
- Do not upload illegal, harmful, or infringing content.
- Do not interfere with the Service or its security.
- Do not copy, scrape, or systematically download the Service's code, games, or content, or republish them elsewhere.
- Do not decompile, deobfuscate, or reverse engineer the Service, or use it to build a competing or substantially similar product, except to the limited extent applicable law expressly permits.
Fees
Readflexes is currently provided at no cost. If we introduce paid features in the future, we will make the applicable pricing and terms clear before you are charged.
Intellectual property
We own the Service and its content, except for user content and third party materials. The Service's software, game designs and mechanics, graphics, and educational content are protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended educational purpose; no other rights are granted, and no right to the Service's source code is granted. The "Readflexes" name and branding may not be used without our prior written permission. You retain ownership of content you create in the Service.
Third-party services
The Service integrates with third-party services (such as Google Classroom, Google Cloud, and Unsplash). Your use of those services is governed by their terms, and the providers we rely on are listed in our Privacy Policy.
Disclaimer
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.
Limitation of liability
To the maximum extent permitted by law, Readflexes will not be liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits any obligation Readflexes has expressly agreed to in a signed DPA.
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules, except where a signed DPA specifies otherwise.
Changes
We may update these Terms from time to time. If we make material changes, we will update the effective date and provide notice where required.
